Nonprofit organizations are obligated to provide certain types of transparency—the types required by the federal tax system and by state laws aimed at maintaining the donor’s intent. Recent calls for even more transparency have increased the need for organizations to more carefully consider what information they will release to the public and exactly how they will do it.
To help organizations with these questions, John Tyler, noted legal scholar and general counsel of the Ewing Marion Kauffman Foundation, joins us to discuss the benefits and costs of transparency for the nonprofit sector. He argues against additional legally imposed requirements, and suggests a voluntary and measured transparency that can help make the case for the value your organization brings to the community. This more thoughtful approach to transparency takes into account the mission of the organization and the potential costs that would go along with disclosure.
John has written numerous articles, monographs, and book chapters on a variety of topics related to the charitable sector, including on transparency, principles of American policy that unite and enable entrepreneurship and philanthropy, why charitable assets are not “public money,” and hybrid business forms. In addition, he frequently gives talks locally and nationally on the above topics and others, including co-presenting a keynote with Gary White from Water.org at the 2013 Nonprofit Solutions Conference.
